Consultation on the proposed EU Regulation on jurisdiction, applicable law, recognition and enforcement of decisions and authentic instruments in matters of succession

EU citizens often move to other Member States for work. This may lead to a situation where they own property in more than one Member State. Upon their death, problems could arise as to the regulation of their succession given that the rules regulating succession vary between one Member State and another.

Last October, the Commission adopted a proposal for a Regulation which will govern the jurisdiction, applicable law, recognition and enforcement of decisions and authentic instruments in matters of succession.

In this context, MEUSAC organised a briefing and consultation session for stakeholders on the issues involved, the current discussions taking place and developments to be expected in the near future. The session was of particular interest to all operators in the field including notaries, lawyers, trustees and bankers. It was held on the 21st January at 15.00hrs at 254, Europe House, St. Paul’s Street, Valletta.
